What happened to you doesn't define you: the law protects you
The U visa exists for victims of certain serious crimes — for example domestic violence, assault, or armed robbery, among others — who suffered physical or emotional harm and who helped, or are willing to help, police or prosecutors. A key step is the certification from a law-enforcement agency, such as the Houston Police Department or Harris County agencies; we prepare that request and follow up on it for you.
VAWA lets a person who suffered abuse by a U.S.-citizen or lawful-resident spouse, parent, or adult son or daughter file their own self-petition — the law protects women and men equally. The person who abused you is never notified: federal confidentiality protections forbid it, and you can apply without their knowledge or permission. The T visa, in turn, protects victims of labor or sex trafficking. In many cases, all three paths can lead over time toward a green card.

What crimes can qualify for the U visa?
The law lists serious crimes such as domestic violence, sexual assault, aggravated assault, kidnapping, armed robbery and others. These are examples, not a complete list. Can I apply if I am undocumented?
Yes. The U visa, VAWA and the T visa were created precisely to protect victims regardless of immigration status. Being undocumented does not disqualify you — these laws exist exactly for people in your situation.
Will my abuser find out if I file a VAWA petition?
No. Federal law protects the confidentiality of your petition: the government is prohibited from notifying the person who abused you or sharing your information with them. You can file without their knowledge and without their permission, whether you are a man or a woman.
How long does the U visa take, and can I work while I wait?
Waits are long, often several years, because there is an annual cap on U visas. However, USCIS can review your application while it is pending and, in many cases, grant protections and a work permit during the wait. Every case is different; we review which options apply to yours.
Can my children be included in my case?
In many cases, yes. Certain qualifying family members — such as unmarried children under a certain age and, depending on your situation, other relatives — may be included as derivatives in a U visa, VAWA or T visa case. We review this with you at your appointment.
